สวัสดีค่ะคุณทนายภูวรินทร์
หนูจดทะเบียนสมรสกับสามี หลังจากนั้นไม่นานก็ตั้งครรภ์ค่ะ แต่ต้องแยกกันอยู่เพราะสามีทำร้ายร่างกายหนูขณะที่ยังตั้งครรภ์ หนูได้แจ้งความดำเนินคดีสามีไปแล้ว ทีนี้หนูอยากจะถามว่า ถ้าสามีเรียนจบแล้ว แต่ไม่ได้ทำงาน หนูจะเรียกค่าเรียกดูบุตรได้ไหมคะ เพราะว่าสถานะของหนูตอนนี้ยังเรียนไม่จบค่ะ กรณีไกล่เกลี่ยแล้วสามีไม่ยอมจ่ายให้ ถ้าหนูฟ้องศาล ศาลจะตัดสินอย่างไรคะ

มาตรา 1598/38 ค่าอุปการะเลี้ยงดูระหว่างสามีภริยา หรือระหว่างบิดามารดากับ บุตรนั้นย่อมเรียกจากกันได้ในเมื่อฝ่ายที่ควรได้รับอุปการะเลี้ยงดูไม่ได้รับการอุปการะเลี้ยงดูหรือ ได้รับการอุปการะเลี้ยงดูไม่เพียงพอแก่อัตภาพ ค่าอุปการะเลี้ยงดูนี้ศาลอาจให้เพียงใดหรือไม่ให้ก็ได้ โดยคำนึงถึงความสามารถของผู้มีหน้าที่ต้องให้ ฐานะของผู้รับและพฤติการณ์แห่งกรณี

มาตรา 1598/39 เมื่อผู้มีส่วนได้เสียแสดงว่าพฤติการณ์ รายได้ หรือฐานะของ คู่กรณีได้เปลี่ยนแปลงไป ศาลจะสั่งแก้ไขในเรื่องค่าอุปการะเลี้ยงดูโดยให้เพิกถอน ลด เพิ่ม หรือ กลับให้ค่าอุปการะเลี้ยงดูอีกก็ได้ 
ในกรณีที่ศาลไม่พิพากษาให้ค่าอุปการะเลี้ยงดู เพราะเหตุแต่เพียงอีกฝ่ายหนึ่ง ไม่อยู่ในฐานะที่จะให้ค่าอุปการะเลี้ยงดูได้ในขณะนั้น หากพฤติการณ์ รายได้ หรือฐานะของอีก ฝ่ายหนึ่งนั้นได้เปลี่ยนแปลงไป และพฤติการณ์รายได้หรือฐานะของผู้เรียกร้องอยู่ในสภาพที่ควร ได้รับค่าอุปการะเลี้ยงดู ผู้เรียกร้องอาจร้องขอให้ศาลเปลี่ยนแปลงคำสั่งในคดีนั้นใหม่ได้

มาตรา 1598/40 ค่าอุปการะเลี้ยงดูนั้นให้ชำระเป็นเงินโดยวิธีชำระเป็นครั้งคราว ตามกำหนด เว้นแต่คู่กรณีจะตกลงกันให้ชำระเป็นอย่างอื่นหรือโดยวิธีอื่น ถ้าไม่มีการตกลงกันและ มีเหตุพิเศษ เมื่อฝ่ายใดฝ่ายหนึ่งร้องขอและศาลเห็นสมควร จะกำหนดให้ค่าอุปการะเลี้ยงดูเป็น อย่างอื่นหรือโดยวิธีอื่น โดยจะให้ชำระเป็นเงินด้วยหรือไม่ก็ได้ 
ในกรณีขอค่าอุปการะเลี้ยงดูบุตร เมื่อมีเหตุพิเศษและศาลเห็นเป็นการสมควรเพื่อ ประโยชน์แก่บุตร จะกำหนดให้บุตรได้รับการอุปการะเลี้ยงดูโดยประการใด ๆ นอกจากที่คู่กรณี ตกลงกัน หรือนอกจากที่ฝ่ายใดฝ่ายหนึ่งร้องขอก็ได้ เช่นให้ไปอยู่ในสถานการศึกษาหรือวิชาชีพ โดยให้ผู้ที่มีหน้าที่ต้องชำระค่าอุปการะเลี้ยงดูออกค่าใช้จ่ายในการนี้

มาตรา 1598/41 สิทธิที่จะได้ค่าอุปการะเลี้ยงดูนั้น จะสละหรือโอนมิได้และไม่อยู่ ในข่ายแห่งการบังคับคดี

        ค่าอุปการะเลี้ยงดูบุตรนั้นกฎหมายกำหนดให้พิจารณาจากความสามารถของผู้ให้ด้วย ดังนั้น เมื่อขณะนี้สามียังศึกษาอยู่ไม่มีรายได้ ศาลอาจยังไม่กำหนดให้ก็ได้ตามหลักกฎหมายดังกล่าว แต่ค่าอุปการะเลี้ยงดูบุตรสามารถเรียกย้อนหลังได้ ดังนั้น เมื่อใช้จ่ายอะไรก็ควรเก็บหลักฐานการจ่ายเงินไว้เพื่อประกอบการฟ้องในอนาคตเมื่อสามีจบการศึกษาและมีงานทำแล้ว

กรณีนี้ต้องใช้สิทธิทางศาลเพื่อให้ศาลบังคับให้ชำระค่าเลี้ยงดูบุตรได้ครับ ส่วนจะได้เท่าใดนั้น ขึ้นอยู่กับดุลพินิจของศาลประกอบกับข้อเท็จจริงของคดีทั้งหมดประกอบกัน
