ดิฉันเป็นเจ้าหนี้ให้กับหลานห่างๆ ซึ่งเป็นลูกของญาติห่างๆ(มากคนหนึ่ง) ซึ่งปัจจุบันหลานคนนี้ไม่สามารถจะชำระหนี้ให้แก่ดิฉันได้ เพราะเงินนั้นศูนย์ไปกับการลงทุนทำธุรกิจส่วนตัวแล้วไม่ประสบผลสำเร็จ แล้วติดหนี้สินมากมาย หลานคนนี้เป็นหนี้ดิฉันเป็นจำนวนเงิน 5 ล้านกว่าบาทโดยมีเอกสารสัญญาการกู้ยืมเงินกันเมื่อในปี
2548
แรกๆหลานคนนี้ก็ทยอยชำระหนี้ให้ (ตกลงกันว่าเป็นการยืมเงินและจะจ่ายเป็นดอกเบี้ยที่ต่ำกว่าธนาคารเล็กน้อย เนื่องจากเห็นว่าเป็นลูกของญาติ และดิฉันก็ไม่ได้ลำบากเรื่องการเงิน)
แต่เมื่อปี 2552 ภาวะของธุรกิจเริ่มประสบปัญหา และจนถึงปีนี้ หลานคนนี้ได้เอาเงินส่วนหนึ่งไปลงทุนทำธุรกิจนำเข้า-ส่งออกและประสบเหตุช่วงเสื้อเหลือง-เสื้อแดง ทำให้ปิดกิจการและเกิดหนี้สินอีก
เท่าที่เช็คนอกจากหลานคนนี้จะมีทรัพย์สินส่วนตัวเป็นรถยนต์แล้วยังมีบ้านอีกหลังนึงซึ่งปลูกบนที่ดินของแม่(ญาติห่างๆของดิฉัน ซึ่งนับเป็นลูกพี่ลูกน้องกัน)และทำให้หลานดิฉันขาดส่งเงินมาตั้งแต่ปี 52-ปัจจุบัน

ขอถามคุณทนายค่ะว่ากรณีแบบนี้ หากดิฉันต้องการยึดบ้านของหลาน(ซึ่งเป็นลูกหนี้) โดยที่บ้านหลังนี้ปลูกอยู่บนที่ดินที่บุคคลอื่นแบบนี้จะทำเรื่องขอยึดได้หรือไม่คะ

กรณีนี้เจ้าหนี้ต้องทราบก่อนครับ ว่าบ้านหลังนี้เป็นของหลาน(ลูกหนี้)จริงๆ และปลูกอยู่บนที่ดินของบุคคลอื่นโดยได้รับความยินยอมจากเจ้าของที่ดินแล้วอย่างนี้จะขอยึดทรัพย์สินได้ครับ บ้านไม่เป็นส่วนควบของที่ดิน

กรณีที่เจ้าหนี้ต้องการที่จะยึดทรัพย์ประเภทรถยนต์ของลูกหนี้ เอกสารที่ต้องเตรียมในการขอยึดทรัพย์ที่สำคัญมากๆคือ
*คุณต้องมีสำเนาคู่มือการใช้รถยนต์ หรือคู่มือการใช้รถยนต์ให้เจ้าพนง.บังคับคดีเพื่อตรวจสอบว่ามีชื่อลูกหนี้เป็นผู้ครอบครองไปยึดให้* เพื่อไม่ให้เกิดความผิดพลาดเนื่องจากคู่มือการใช้รถฯจะเป็นเอกสารการชำระเงินค่าภาษีและการควบคุมยานพาหนะเท่านั้น ผู้ใดครอบครองใช้สอย กฎหมายจะสันนิษฐานว่าเป็นเจ้าของผู้ถือกรรมสิทธิ์ในทรัพย์นั้น
