จะรบกวนถามว่าถ้าลูกค้าซื้อสิ้นค้าแล้วไม่ชำระเงิน ถ้าเราจะฟ้องร้องต้องฟ้องร้องหรือแจ้งความในพื้นที่ที่ออกบิลหรือต้องฟ้องร้องพื้นที่ที่สำนักงานใหญ่ตั้งอยู่คะ

       เมื่อลูกค้าซื้อสินค้าแล้วไม่ชำระเงิน เป็นคดีทางแพ่ง ไม่ใช่คดีอาญา ดังนั้น การไปแจ้งความเพื่อให้ดำเนินคดีอาญาหรือคดีแพ่งกับเจ้าหน้าที่ตำรวจ จึงไม่สามารถทำได้ (ลงบันทึกประจำวันเป็นหลักฐานได้แต่ไม่ก่อให้เกิดสิทธิใด ๆ) เพราะรัฐไม่มีบริการฟ้องคดีแพ่งให้ผู้เสียหาย ซึ่งตามกฎหมายเจ้าหนี้มีสิทธิฟ้องร้องให้ลูกค้าชำระเงินได้ภายในกำหนดอายุความ ดังนี้
     1. หากลูกค้าเป็นผู้บริโภค คือ ซื้อสินค้าไปเพื่อใช้บริโภค หรืออุปโภค ต้องใช้สิทธิฟ้องศาลภายในอายุความ 2 ปี
     2. หากลูกค้าเป็นผู้ประกอบธุรกิจ คือ ซื้อสินค้าเพื่อนำไปประกอบธุรกิจ หรือซื้อมาขายไป หรือเกี่ยวเนื่องกับการประกอบธุรกิจ ต้องใช้สิทธิฟ้องศาลภายในกำหนดอายุความ 5 ปี
     
       สำหรับศาลที่จะยื่นฟ้องคดีนั้น ก็แบ่งแยกตามประเภทลูกค้าเช่นกัน โดยมีหลักกฎหมายอ้างอิง ได้แก่ ประมวลกฎหมายวิธีพิจารณาความแพ่ง มาตรา 4 (1) บัญญัติว่า "คำฟ้อง ให้เสนอต่อศาลที่จำเลยมีภูมิลำเนาอยู่ในเขตศาล หรือต่อศาลที่มูลคดีเกิดขึ้นในเขตศาลไม่ว่าจำเลยจะมีภูมิลำเนาอยู่ใน ราชอาณาจักรหรือไม่"
       หมายความว่า การฟ้องคดีต่อศาลนั้น ให้ยื่นฟ้องต่อศาลที่จำเลย (ผู้ถูกฟ้อง) มีภูมิลำเนาอยู่ในเขตศาล หรือต่อศาลที่มูลคดี ได้แก่ เหตุอันเป็นที่มาของการโต้แย้งสิทธิ์ หรือเหตุที่อ้างฟ้อง เกิดขึ้นในเขตศาล เช่น สถานที่ทำสัญญา สถานที่ผิดสัญญา เป็นต้น หากลูกค้าเป็นนิติบุคคลก็ฟ้องต่อศาลที่ลูกค้ามีสำนักงานใหญ่ตั้งอยู่
      แต่การฟ้องร้องคดีผู้บริโภคนั้นมีข้อยกเว้นคือ พระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 มาตรา 17  บัญญัติว่า "ในกรณีที่ผู้ประกอบธุรกิจจะฟ้องผู้บริโภคเป็นคดีผู้บริโภคและผู้ประกอบธุรกิจมีสิทธิเสนอคำฟ้องต่อศาลที่ผู้บริโภคมีภูมิลำเนาอยู่ในเขตศาลหรือต่อศาลอื่นได้ด้วย ให้ผู้ประกอบธุรกิจเสนอคำฟ้องต่อศาลที่ผู้บริโภคมีภูมิลำเนาอยู่ในเขตศาลได้เพียงแห่งเดียว"  ดังนั้น หากเป็นคดีผู้บริโภค เจ้าหนี้มีสิทธิฟ้องศาลได้เพียงแห่งเดียว คือ ศาลที่ลูกค้ามีภูมิลำเนาอยู่ในเขตศาลเท่านั้น ซึ่งหากลูกค้าอยู่ต่างจังหวัดกับเจ้าหนี้ก็ทำให้เสียค่าใช้จ่ายในการฟ้องคดีเพิ่มมากขึ้น

       ตัวอย่างคำพิพากษาศาลฎีกาที่ 2916/2548
       โจทก์ทำสัญญาซื้อขายเครื่องกำเนิดไฟฟ้าพร้อมอุปกรณ์กับจำเลยที่บริษัทจำเลยซึ่งตั้งอยู่ที่กรุงเทพมหานครโดยมีข้อตกลงให้จำเลยนำเครื่องกำเนิดไฟฟ้าไปส่งมอบและติดตั้งให้แก่โจทก์ ณ จังหวัดราชบุรี พร้อมด้วยเงื่อนไขว่า เครื่องกำเนิดไฟฟ้าจะต้องเดินเครื่องยนต์และจ่ายกระแสไฟฟ้าได้อย่างต่อเนื่องตามคุณสมบัติที่ตกลงกัน โจทก์จึงจะชำระราคาที่เหลือให้แก่จำเลย เมื่อโจทก์อ้างว่าจำเลยนำเครื่องกำเนิดไฟฟ้าที่มีคุณสมบัติไม่ตรงตามข้อกำหนดในสัญญาไปส่งมอบและติดตั้งอันเป็นการผิดสัญญา ก็เท่ากับมีข้อโต้แย้งเกิดขึ้นเกี่ยวกับสิทธิและหน้าที่ตามสัญญาซื้อขายดังกล่าวในส่วนที่เกี่ยวข้องกับเงื่อนไขในการส่งมอบและติดตั้ง จังหวัดราชบุรีซึ่งเป็นสถานที่ที่ต้องมีการส่งมอบและติดตั้งเครื่องกำเนิดไฟฟ้า จึงเป็นสถานที่ที่มูลคดีเกิดอีกแห่งหนึ่งด้วย โจทก์ย่อมมีอำนาจฟ้องจำเลยต่อศาลจังหวัดราชบุรีได้

       โจทก์ฟ้อง ขอให้บังคับจำเลยทั้งสามร่วมกันชำระเงิน 3,236,872.60 บาท แก่โจทก์ และให้ร่วมกันขนย้ายเครื่องกำเนิดไฟฟ้าพร้อมอุปกรณ์ของจำเลยทั้งสามออกไปจากสำนักงานสาขาของโจทก์เลขที่ 88 หมู่ที่ 2 ตำบลดอนทราย อำเภอปากท่อ จังหวัดราชบุรี โดยค่าใช้จ่ายของจำเลยทั้งสาม
       ศาลชั้นต้นเห็นว่า มูลคดีและภูมิลำเนาของจำเลยทั้งสามมิได้อยู่ในเขตอำนาจศาลชั้นต้น จึงมีคำสั่งไม่รับคำฟ้อง คืนค่าขึ้นศาลทั้งหมดให้แก่โจทก์
       โจทก์อุทธรณ์เฉพาะปัญหาข้อกฎหมายโดยตรงต่อศาลฎีกา โดยได้รับอนุญาตจากศาลชั้นต้น ตาม ป.วิ.พ. มาตรา 223 ทวิ
       ศาลฎีกาวินิจฉัยว่า ข้อเท็จจริงตามคำฟ้องรับฟังได้ว่า โจทก์ทำสัญญาซื้อขายเครื่องกำเนิดไฟฟ้าพร้อมอุปกรณ์กับจำเลยทั้งสามที่บริษัทจำเลยที่ 3 ซึ่งตั้งอยู่ที่กรุงเทพมหานครโดยมีข้อตกลงให้จำเลยทั้งสามนำเครื่องกำเนิดไฟฟ้าไปส่งมอบและติดตั้งให้แก่โจทก์ ณ จังหวัดราชบุรี พร้อมด้วยเงื่อนไขว่า เครื่องกำเนิดไฟฟ้าจะต้องเดินเครื่องยนต์และจ่ายกระแสไฟฟ้าได้อย่างต่อเนื่องตามคุณสมบัติที่ตกลงกัน โจทก์จึงจะชำระราคาที่เหลือให้แก่จำเลยทั้งสาม เมื่อโจทก์อ้างว่าจำเลยทั้งสามนำเครื่องกำเนิดไฟฟ้าที่มีคุณสมบัติไม่ตรงตามข้อกำหนดในสัญญาไปส่งมอบและติดตั้งอันเป็นการผิดสัญญา ก็เท่ากับมีข้อโต้แย้งเกิดขึ้นเกี่ยวกับสิทธิและหน้าที่ตามสัญญาซื้อขายดังกล่าวในส่วนที่เกี่ยวข้องกับเงื่อนไขในการส่งมอบและติดตั้ง จังหวัดราชบุรีซึ่งเป็นสถานที่ที่ต้องมีการส่งมอบและติดตั้งเครื่องกำเนิดไฟฟ้า จึงเป็นสถานที่ที่มูลคดีเกิดอีกแห่งหนึ่งด้วย โจทก์ย่อมมีอำนาจฟ้องจำเลยทั้งสามต่อศาลจังหวัดราชบุรีได้
