เงินมัดจำ หรือเงินประกันความเสียหายในการปฏิบัติตามสัญญาเช่า เมื่อผู้เช่าจ่ายให้แก่ผู้ให้เช่าไปแล้ว กรรมสิทธิ์ในเงินก็ตกเป็นของผู้ให้เช่า เพียงแต่หากสิ้นสุดสัญญาเช่า และผู้ให้เช่าตรวจสอบความเสียหายแล้ว ปรากฏว่าไม่เกิดความเสียหายอะไร หรือเกิดความเสียหายแต่เป็นส่วนน้อย ผู้ให้เช่าก็มีหน้าที่จะต้องคืนเงินประกันความเสียหายนั้นแก่ผู้เช่า ซึ่งเป็นเรื่องหน้าที่ตามที่กำหนดไว้ในสัญญาเช่า และเป็นคดีความทางแพ่ง ไม่ใช่คดีอาญา

หากผู้ให้เช่าไม่ยอมคืน หรือคืนไม่ครบ ผู้เช่าก็ต้องใช้สิทธิทางศาลเพื่อเรียกร้องให้จ่ายคืน ผู้เช่าไม่สามารถแจ้งความดำเนินคดีอาญากับผู้ให้เช่าได้ ซึ่งก่อให้เกิดปัญหาทางปฏิบัติมาก เพราะหากเงินประกันดังกล่าวมีจำนวนน้อย การใช้สิทธิทางศาลก็ไม่คุ้มค่ากับการดำเนินคดี

แต่คดีในลักษณะนี้ เป็นคดีผู้บริโภค คุณสามารถยื่นคำร้องที่สำนักงานคุ้มครองผู้บริโภคเพื่อให้ดำเนินการแทน หรือเอาสัญญาเช่าไปปรึกษากับนิติกรศาล เพื่อให้นิติกรศาลดำเนินคดีให้ โดยไม่เสียค่าใช้จ่ายครับ
